California AG Takes Trump to Court Over Alleged Illegal National Guard Deployment

California Attorney General Rob Bonta is challenging the Trump administration in court, accusing the president of illegally deploying the state’s National Guard to enforce immigration raids in Los Angeles.

The trial, beginning today in Los Angeles before Judge Breyer, centers on whether Trump’s move violated the Posse Comitatus Act of 1878, a long-standing law that bars the use of the military for civilian law enforcement.

Bonta alleges that, over the past two months, National Guard troops and Marines have been stationed in Los Angeles performing civilian policing duties, including setting up blockades, controlling perimeters, and even making arrests — activities he says are clearly prohibited under federal law.

Although Trump has begun withdrawing some personnel, Bonta says roughly 300 National Guard members remain active in Los Angeles. He argues their continued presence is unlawful and disrupts critical state work such as combating wildfires and tackling the fentanyl crisis.

The case is one of 37 lawsuits California has filed against Trump in his second term, with the state winning most of the cases that have reached a court order.

The dispute comes amid heightened tensions over federal immigration enforcement in California. Bonta also condemned recent ICE operations in Van Nuys, where agents in unmarked vehicles allegedly detained immigrant day laborers in defiance of a court order prohibiting racially targeted raids. He warned that such actions may violate the Fourth Amendment and promised accountability.

Speaking at the Netroots Nation conference in New Orleans alongside other Democratic attorneys general, Bonta emphasized that legal challenges are key to curbing what he calls Trump’s “lawless” behavior. He cited a 90% success rate in California’s lawsuits against the administration, which he says have protected billions in federal funds for the state.

“Our message is clear,” Bonta said. “When we push back in court, we win — and we will keep fighting to uphold the Constitution.”
